In compliance with Article 10 of Law 34/2002, of July 11, on information society services and electronic commerce, it is informed that this website, its associated services, and the application linked to the Clave de Mi project are owned by:

This Legal Notice regulates access, navigation, and use of Clave de Mi, including, by way of example but not limited to:

  • the main website and its various pages, sections, and contents;
  • private areas, forms, user accounts, and associated services;
  • the web version of the player and musical tools of the project;
  • the Android mobile application linked to Clave de Mi, currently identified as MIDI & MusicXML Player;
  • the content, services, digital products, premium functionalities, community spaces, and any tools related to the project.

Access or use of any of these environments grants the status of user and implies acceptance of this Legal Notice, without prejudice to particular conditions that may apply to certain services, purchases, subscriptions, digital content, or specific functionalities.

3. Purpose of the project and services

Clave de Mi is a digital project focused on the musical field that may offer, among others, educational content, scores, methods, books, music-related services, tools for playback and visualization of musical files, user file upload functionalities, premium or subscription services, as well as advertising or affiliate content.

The Owner may modify, expand, limit, suspend or withdraw, totally or partially, content, functionalities, or services of Clave de Mi when deemed necessary for its correct operation, maintenance, improvement, regulatory compliance, or protection of own or third-party rights.

4. User status and proper use of the service

The user agrees to use Clave de Mi, its contents, and its services in accordance with the law, good faith, public order, this Legal Notice, and, where applicable, the specific conditions that apply.

It is prohibited, among other uses, to use Clave de Mi to:

  • engage in illegal, fraudulent activities or those contrary to the rights of third parties;
  • to introduce, host, share or disseminate content that violates third-party intellectual property rights, industrial property rights, image rights, honor, privacy or data protection rights;
  • to upload malicious files, viruses, harmful code or elements that may affect the operation of the site, app or third-party systems;
  • to alter, attempt unauthorized access, overload or harm the security, integrity or availability of the platform;
  • to use the services for exclusively unauthorized commercial purposes, or in a way that distorts their purpose.

The Owner may take measures it deems reasonable and proportionate against uses contrary to this Legal Notice, including content removal, functionality limitation, account suspension or cooperation with competent authorities when legally appropriate.

5. User account, access to functionalities and usage modalities

Some functionalities of Clave de Mi may require prior registration, contracting, subscription or payment. The user shall be responsible for the accuracy of the data provided, the custody of their credentials, and the use made from their account.

Access to certain functions, content or storage and visibility modalities may vary depending on the type of user, the plan contracted, or the particular conditions in force at any given time.

6. Content provided by users

Clave de Mi may allow users to upload, store, process, view, reproduce or share files, scores, documents or other materials related to the service.

The user guarantees that the content they upload, share or make available through Clave de Mi:

  • is owned by them, or they have authorization, license or sufficient legitimate basis to do so;
  • does not infringe intellectual or industrial property rights, image rights, trade secrets or other third-party rights;
  • does not contain illicit, harmful, misleading, defamatory, offensive or contrary material to applicable regulations.

As a general rule, the user assumes responsibility for the content they provide and for the consequences arising from its publication, storage, communication or use within the platform.

Depending on the usage modality available at any time:

  • content uploaded by users without a Premium subscription may be visible to the community within Clave de Mi functionalities;
  • users with a Premium subscription may have, when the functionality is enabled, options to configure certain content as public or private.

When a user uploads content to Clave de Mi, they authorize the Owner, to the extent necessary to provide the requested service and according to the chosen or applicable visibility settings, to host, store, index, technically process, adapt to the required format for its operation, reproduce, display and make such content available within the Clave de Mi environment.

The Owner does not conduct an exhaustive prior review of all content uploaded by users. However, it reserves the right to remove, block, limit or review content when there are indications of illegality, rights infringement, breach of this Legal Notice, technical risks or requirements from competent authorities.

7. Intellectual and industrial property

All rights over Clave de Mi’s own content are reserved. By way of example, this includes the design, structure, selection and organization of content, own texts, own images, logos, distinctive signs, code, developments, functionalities, interfaces and other project elements when owned by the Owner or legitimately exploited under license or authorization.

Access to Clave de Mi does not imply transfer, transmission, general license or waiver of intellectual or industrial property rights, except in cases expressly indicated.

It is not allowed to reproduce, distribute, publicly communicate, transform, extract, reuse or exploit project contents, in whole or in part, for commercial or public purposes without prior written authorization from the Owner or the third party holding the rights.

Third-party content, including scores, music files, methods, linked materials or content provided by users, may be protected by intellectual property rights or other applicable regulations. The mere availability, viewing, indexing, linking or presence of such materials in Clave de Mi does not imply that the Owner holds rights over them nor authorizes uses other than those permitted by law or their respective holders.

8. External links, third-party content, affiliation and advertising

Clave de Mi may include links to websites, products, services, platforms or resources of third parties, as well as sponsored content, advertising or affiliate links.

The existence of such links or mentions is informative, commercial or promotional in nature, as applicable, and does not necessarily imply recommendation, control, approval or guarantee by the Owner regarding content, policies, products, services or practices of third parties.

The Owner may receive income or commissions for certain purchases, contracts or actions made through affiliate links, without this implying, by itself, an increase in price for the user.

The Owner is generally not responsible for the content, availability, terms of use, privacy policies, commercial practices or operation of third-party websites or services, without prejudice to legal obligations that may correspond when it has effective knowledge of illegal content or activities and does not act with due diligence.

9. Procedure for notification and removal of content

If anyone considers that any content hosted, linked, indexed, or made available through Clave de Mi infringes intellectual property, industrial property, image rights, data protection rights, or any other rights, they may notify the Owner via the email address info@clavedemi.com.

The communication should include, as far as possible:

  • identification of the claimant and contact information;
  • sufficient identification of the allegedly unlawful or infringing content and its exact location within Clave de Mi;
  • a reasoned explanation of the grounds for the claim;
  • documentation or reasonable evidence proving ownership of the right or sufficient representation, when applicable.

Upon receiving a sufficiently substantiated communication, the Owner may analyze it and adopt, with reasonable diligence and without automatically assuming liability, any measures deemed appropriate, including removal, de-indexing, access restriction, or request for additional information.

10. Availability, technical operation, and limitation of liability

The Owner strives to ensure that Clave de Mi operates correctly and with a reasonable level of continuity, security, and updating. However, it cannot guarantee the permanent availability of the website, app, services, files, content, absence of errors, or lack of interruptions due to technical causes, maintenance, network incidents, third-party actions, incompatibilities, updates, force majeure, or circumstances beyond its control.

Consequently, the Owner shall not be liable for damages or losses exclusively resulting from technical incidents, unavailability, occasional errors, interruptions, network failures, or third-party actions, except in cases where the law expressly states otherwise.

The user acknowledges that they use Clave de Mi at their own risk and should ensure, when appropriate, that they have backups of their files, review the adequacy of the service for their needs, and use legitimate sources for materials they upload, download, or consult.

11. Personal data protection and cookies

The processing of personal data carried out through Clave de Mi is governed by the corresponding Privacy Policy.

The use of cookies, similar technologies, and, if applicable, consent management systems is governed by the corresponding Cookie Policy and by the settings applicable in each project environment.

12. Specific conditions for purchase, contracting, or subscription

The purchase of products, digital content, services, subscriptions, or paid features through Clave de Mi may be subject, in addition to this Legal Notice, to Terms and Conditions, contracting conditions, cancellation policies, or additional commercial information provided prior to purchase or contracting.

13. Modifications

The Owner reserves the right to modify this Legal Notice at any time to adapt it to regulatory, technical, functional, organizational, or business model changes. The version published at any given time will be applicable from its publication date.

14. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law.

In case of dispute or conflict related to the interpretation, validity, or enforcement of this Legal Notice, the parties will submit to the courts and tribunals that are competent under the applicable law. Where consumer and user law grants the user the option to go to the courts of their domicile, such jurisdiction will be respected.
